Calgary TV personality sues over dunk tank incident.

A poor splashdown at a dunk tank two years ago has Global TV personality Leslie Horton seeking $150,000 in damages after she banged her head.

In a statement of claim filed in Calgary Court of Queen’s Bench, Horton said she suffered serious injuries at an event put on by the Calgary Police Association on July 5, 2014.

Horton’s lawsuit names the CPA, the Calgary Police Service — since the incident happened on their premises at the Westwinds Campus — the City of Calgary and Tubby’s Hot Tub and Party Rentals Inc., which supplied the dunk tank.

“At the time of her attendance at the event, the plaintiff was invited to participate in the use of a dunk tank,” Horton’s claim reads.

“In the course of this participation, the plaintiff struck her head on an unpadded protrusion of the dunk tank.”

The claim says Horton suffered “traumatic brain injury” and other wounds, including memory loss and concentration problems.

“As a result of the accident, the plaintiff has been required to undergo and will continue to require lengthy and painful therapy for (her) rehabilitation,” it says.

Her injuries have impacted Horton’s ability to work providing traffic reports on Global news.

“As a further result of the accident, the plaintiff has suffered and will continue to suffer loss of income as a result of being restricted in her ability to work,” the claim states.

The company which provided the dunk tank failed to provide one that was “reasonably safe for the use intended,” her lawsuit says.

The CPA, CPS, and the city also failed to ensure Horton and other users of the dunk tank were provided adequate safety at the event.

The city was named as a defendant because it owns the property where the police headquarters is located.

Statements of defence disputing the allegations which have not been proven in court haven’t been filed.

Wouldn't she have had to sign a waiver before participating? If not, the organizers have left themselves wide open to a lawsuit.
