Will be interesting to see how this works with Cancon. The rules are pretty clear that songs must be played in their entirety to count.

Edit: Just heard a 90 second Danny Fernandez song....

(8) Except as otherwise provided under a condition of its licence that refers expressly to this subsection and subject to subsection (6), an A.M. licensee, F.M. licensee or digital radio licensee that is licensed to operate a commercial station, community station or campus station shall, in a broadcast week, devote at least 35% of its musical selections from content category 2 to Canadian selections broadcast in their entirety.

Not sure that the CRTC has considered the issue of musical selections NOT played in their entirety. Clearly, music in commercials or imaging doesn't count.

Until the CRTC clarifies the issue, I suspect that a clever legal department would argue that AMP is not playing any musical selections to which CanCon rules apply.

Or, to put it another way, what is good for the gander is good for the goose. If CanCon not played in its entirety doesn't count, then why should non-CanCon count if it is not played in its entirety?

Lawyers could spin this one out several ways if challenged by the CRTC.

My guess is that the CRTC will come out with a specific ruling on the matter, in essence saying that, for songs that played in their entirety, CanCon selections not played in their entirety count, and are required.

I"m not sure the "nothing we're playing is in its entirety so therefore we're not actually playing any music at all" argument will fly. If that were the case, they wouldn't need to play any Cancon at all....and they are.

The only loophole I can see is that these are simply different *versions* of the songs, and these versions are in fact being played in their entirety.

Listening to AMP now will be like listening to an old K-Tel LP with edited versions of hit songs.

Stations don't need to play any CanCon overnight, but they do. Stations didn't need to play CanCon before 1971, but they did. Some listeners actually like some CanCon selections.

The "version argument" doesn't work and has been tried before. Last I heard, stations must defend each CanCon (if the CRTC doesn't already have it in their database) by showing a published copy of the song. In the old days, that meant taking pictures of record labels.

There were a lot of can-con records (Canadian pressings) that don't have the MAPL logo on them. Maybe the record companies thought people wouldn't buy them if they knew it was Can-Con.
Those who danced were thought to be quite insane by those who couldn't hear the music.

I don't think the CRTC would bat an eyelash on whether or not the 'entire' song is being played. If Newcap gets called on it, all they need to say is that they're playing the same ratio of music as mandated by their license, at which point it all becomes a non-issue.

Using some hypothetical numbers, if AMP was using regular length songs, it would run about 2016 songs per week, with 706 being cancon. In their new incarnation of 24 songs per hour, that works out to 4032 per week, with 1412 cancon. All that matters at the end of the day is that they hit their 35% quota (though AMP may be a 40% station, but whatever).

They play Cancon overnight because it keeps the daytime rotations on track. AMP is playing their full quota, so they're obviously counting them for compliance purposes. They wouldn't play nearly as much if they weren't counting.

I think the "ratio is fine" argument is probably the right one, though it still technically goes against the rules. So either they cleared it ahead of time, or they're prepared to defend it.

Maybe they'll use it to generate more publicity? Blame the regulator for limiting the number of songs they can play and get more free plugs on the local TV newscasts like their other stunts. They managed to get the local CTV outlet (Bell owns competitor 98.5 Virgin Radio) to put up a daily news poll question about the burning money incident.

Didn't the Big 8 CKLW get leaned on for chopping beavers? They were editing cancon songs until the CRTC put a stop to it.

Yup, but they were editing the songs as a way to circumvent the rules, all in an effort to minimize the airtime spent on cancon. This is a completely different situation. Newcap isn't shirking its license obligations, it's simply repackaging what AMP was and presenting it in a different, albeit speedier, way.

Pat Bohn is not a stupid guy, this would have been one of the first things the SparkNet Communications lawyers would have vetted with the CRTC before even thinking of trying to roll the format out in Canada. The cancon is a non-issue guys, don't worry about it.

I'm more curious than worried.

It's been interesting watching the stations on Montreal and Ottawa using montages to circumvent non-hit, so there could be some precedence here if it's kosher with the CRTC.
